  • Chapter 1 General
    • Article 1 (Purpose)
      • The purpose of these bylaws is to stipulate the matters necessary for the efficient operation of the facilities operated by the Daegu Cultural Arts Promotion Agency (hereinafter referred to as the "Promotion Agency") in accordance with the "Facility Operation Regulations".
    • Article 2 (Scope)
      • ① These bylaws apply to all facilities and equipment of Daegu Opera House (hereinafter referred to as "Opera House").
      • ② The operation of the Opera House shall be governed by these Bylaws, except as specifically provided in other regulations.
    • Article 3 (Location) The Opera House is located at 15 Hoam-ro, Buk-gu, Daegu, Korea.
    • Article 4 (Definitions) As used in these bylaws, the following terms have the following definitions.
      • 1. "Opera House" means the stage and facilities.
      • 2. "Basic facilities" means stages, rehearsal rooms, dressing rooms, waiting rooms, and annexes.
      • 3. "Ancillary facilities" refers to facilities and equipment that do not belong to the basic facilities, such as lighting, sound, musical instruments, cooling and heating systems, etc.
      • 4. "Hire" refers to the use of the facilities in paragraphs 2 and 3, broadcasting (including television), posting of advertisements, filming of movies, and other uses.
      • 5. The person authorized to borrow is referred to as the "borrower".
  • Chapter 2 Subrogation
    • Article 5 (Subrogation Permission)
      • ① Anyone who wishes to rent the facilities under the provisions of Article 5, paragraphs 2 and 3 must obtain permission from the Director. The same applies to changes to the permit.
      • ② The head of the organization may attach conditions if he/she deems it necessary to do so.
    • Article 6 (Subrogation)
      • ① A person who wishes to obtain a rental license pursuant to the provisions of Article 6 shall submit a rental application and rental plan in the form of and to the director, and if he/she wishes to change the license, he/she shall submit a change of use application in the form of .
      • ② If you wish to use the facilities, you must submit an application for use of facilities in the form of when signing a business relationship agreement, and an application for rental of goods in the form of when renting goods.
      • ③ Upon receipt of an application under Paragraphs 1 and 2, the Director shall notify the applicant in writing of the availability of the service and the period for payment of the service fee. However, in case of urgency, the notification may be made by telephone.
      • ④ Regular borrowing shall be done twice a year and shall be confirmed by receiving a batch of applications within the period specified by the director. However, if the director approves, he/she may grant a rental application after one year.
      • ⑤ When the remaining schedule for the current year occurs, the Sushidai Hall receives a batch of applications within the period prescribed by the director and decides by deliberation, and in the case of urgent application 10 days before the desired date of coronation, it is decided according to the procedure prescribed by the director.
      • ⑥ Applications are accepted non-face-to-face, and face-to-face interviews may be allowed if necessary.
    • Section 7 (Contract)
      • ① The lender must enter into a lending agreement with the ledger within 15 days of the lending approval. However, the applicant must sign the rental contract by the deadline specified in the permission notice.
      • ② The application for use of schedules and facilities added after the contract is signed is subject to internal guidelines.
    • Section 8 (Hours of Operation)
      • ① The opera house's rental hours are categorized as follows.
        • 1. morning: from 09:00 to 12:00
        • 2. afternoon: from 13:00 to 17:00
        • 3. night: from 18:00 to 22:00
        • 4. late night: after 22:00 until 09:00 the next day
      • ② Even if the borrower has only used a part of the borrowing time in accordance with the provisions of Paragraph 1, it shall be deemed to have used the entire time.
    • Article 9 (Types of bailment)
      • ① Rentals are classified into regular and occasional rentals depending on the time of application, performance, performance preparation, withdrawal, and practice room rentals depending on the purpose, and other rentals for broadcasting, movie, recording, recording, and advertising production other than performance purposes.
      • ② Performances with a clear commercial purpose, such as movies and musicals, may be rented under a separate contract if part or all of the rental organization is not a domestic performance business.
    • Article 10 (Public Interest)
      • ① The Director shall establish a Steering Committee (formerly known as the Deliberation Committee) (hereinafter referred to as the "Committee") for the efficient management and operation of the deliberation of the agency.

      • ③ Additional fees for basic facilities and incidental facilities incurred after payment of the balance must be paid by the end of the rental period.
      • ④ For long-term performances of more than one week, you can set one day a week (Monday) as a stage inspection day to avoid performances, and in this case, the rental fee is not calculated. However, if Monday is a public holiday, you can substitute another day for the inspection day.
      • ⑤ Hirer does not include value-added tax in its billing of Hirer's fees and charges.
      • ① The Committee shall respond to the Foundation's advice and act in connection with public interest litigation.
      • ② The director of the opera house is the chairperson and conducts the grand jury.
      • ③ The Grand Jury shall consist of no more than 7 members, with at least 50% external members.
      • ④ The members of the Committee shall be appointed by the Director from among persons with specialized knowledge and experience in public affairs.
      • ⑤ The Chairperson may convene a meeting if he or she determines that a public hearing is necessary.
      • ⑥ The Committee shall be quorate with a majority of the members present, and shall make decisions by a majority of the members present.
      • ⑦ A member may be removed, avoided, or evaded in any of the following cases.
        • 1. the review involves the commissioner, his or her spouse, or a person who is or was his or her spouse
        • 2. the review involves a person who is or was related to the commissioner.
        • 3. the member is directly involved in the subject matter of the review
      • ⑧ The term of office of a member shall be two years, but may be renewed once, and in the event of termination, the term of office of the successor shall be the remaining term of the predecessor.
      • ⑨ A member may be dismissed if he or she falls under any of the following subparagraphs.

    • Article 13 (Reduction of Bureaucratic Fees)
      • ① Performances organized or hosted by the government or Daegu Metropolitan City may be exempt from the basic facility rental fee.
      • ② In the case of a hirer belonging to a local arts organization whose business address is located in Daegu Metropolitan City or Gyeongsangbuk-do, the fee may be reduced to the extent not exceeding 50 percent of the basic facility rental fee for pure art activities and educational projects for the promotion of culture and arts.
      • ③ When applying for a government fee reduction, an application form in the form of shall be submitted, and the details shall be determined by separate internal guidelines.
      • ④ Government fees for facilities are not eligible for the reduction of government fees.
    • Article 14 (Return of Duties)
      • The agency fee paid may be returned to the agency in whole or in part after the ledger's approval of the application for cancellation of the agency fee in any of the following cases.
      • 1. In the event that the facility cannot be rented due to natural disasters, infectious diseases, or other force majeure: the rental fee corresponding to the number of days not used out of the rental fee paid.
      • 2. In the event that the facility cannot be rented due to reasons attributable to the Opera House: the rental fee corresponding to the number of days not used out of the rental fee paid.
      • 3. cancel the borrowing for reasons attributable to the borrower
        • a. Cancellation before 30 days : Full refund of usage fee
        • b. 30 days before to the day of use: refund less 10% of the usage fee
        • c. In case of cancellation after the start date: 10% of the usage fee, prorated by the number of days of use, will be refunded.
      • 4. for canceled use of annexes, practice rooms, and facilities
        • a. Cancellation before 7 days : Full refund of usage fee
        • b. Up to 7 days prior to the date of use: refund after deducting 10% of the usage fee
        • c. In case of cancellation after the start date: 10% of the usage fee, prorated by the number of days of use, will be refunded.
    • Article 15 (Limitations on borrowing applications)

      The principal shall not grant a borrowing license if there is a reason falling under any of the following subparagraphs.

      • 1. for the purpose of performing content that violates the Performance Act or the Promotion of Cultural Arts Act
      • 2. for events that may seriously damage the facilities and equipment of the Opera House or are otherwise inappropriate for the maintenance of the Opera House.
    • Article 16 (Revocation of Subscription)
      • ① In the event that any of the following items fall under subparagraph (1), the Director may cancel, suspend, modify, or take other necessary measures. In such a case, the principal shall not be liable for any damages incurred by the borrower.
        • 1. if the information provided in the borrowing application is found to be false after the borrowing is granted.
        • 2. violate the purpose of the rental authorization or fail to pay the rental fee within the specified time limit.
        • 3. if there is a shortage of reserved seats due to issuing too many vouchers without the approval of the ledger
        • 4. significantly disrupts the order of the venue
        • 5. as otherwise deemed to be particularly necessary in the public interest by the Secretary.
    • Article 17 (No Assignment or Subletting of Agency Rights)
      • The Subscriber may not assign or sublet the Subscription to any other person.
    • Article 18 (Changes to Performance Content)
      • ① The borrower may not arbitrarily change the performance itself after signing the borrowing contract. However, if it is inevitable to change the content due to the circumstances of the hirer, the approval of the director must be obtained in advance, and the director may cancel the hiring license if he/she determines that the change of the content is important enough to affect whether the hiring license is granted.
      • ② When making changes, you must submit a document in the form of and obtain the approval of the principal.
    • Article 19 (Rescheduling)
      • The hirer shall submit a document in the form of to obtain the approval of the director in the event of a reason for changing the hiring schedule.
    • Article 20 (Prohibition of Changes to Facilities and Equipment)
      • ① The hirer must obtain the prior approval of the director when changing the facilities, instruments, and equipment of the opera house or bringing in or installing special equipment. In this case, the director may take necessary administrative measures.
      • ② The hirer shall restore the installation, etc. to its original state immediately upon completion of the hiring, and remove the equipment brought in and installed.
      • ③ If the hirer delays the removal, the director may take measures to restore the original situation, such as removing the installation.
      • ④ The Hirer shall not place any installation for commercial purposes unrelated to the performance in the audience and on the stage.
    • Article 21 (Management Obligations and Compensation for Damages)
      • ① The hirer shall fulfill the duty of care as a good manager for the facilities and equipment of the opera house during the hiring period, and shall do its best to prevent fire, especially in the case of equipment, such as flameproofing.
      • ② If the hirer neglects the management duties in Paragraph 1 and causes damage to the facilities and equipment, the hirer shall compensate the amount of damage in cash without delay.
      • ③ The venue shall not be liable for damages for human or material damages incurred in connection with the performance during the rental period.
  • Chapter 3 Ticketing and admission restrictions
    • Article 22 (Issuance of Admission Tickets)
      • ① The hirer must consult with the director in advance to issue admission tickets.
      • ② Before the start of ticket sales, the hirer may request the consignment sales agency to sell tickets by specifying the same performance name, performance date, venue, organization, etc. as the hirer's approval. If there are any changes to the contents of the ticket after requesting the sale, the borrower must obtain prior approval from the director.
      • ③ Admission tickets must include instructions for spectators.
      • ④ The director may reserve some seats as spare seats to facilitate the performance, and the quantity and number of seats shall be determined by separate internal guidelines.
      • ⑤ Tickets shall not be issued in excess of the number of seats, and the number of tickets shall be determined after consultation with the principal before issuing tickets, taking into account the number of variable and spare seats.
      • ⑥ The hirer shall be responsible for any problems caused by the issuance of admission tickets not in accordance with the provisions of Paragraphs 1 and 2. In this case, the principal may claim compensation for damages from the hirer.
      • ⑦ When issuing exchange tickets, prior consultation with the director is required, and the director may refuse admission to visitors if there are not enough reserved seat tickets.
    • Article 23 (Collection of Admission Fees, etc.)
      • ① If the opera house organizes and performs the performance, it may issue admission tickets and collect admission fees. However, if the director recognizes that it is necessary for public interest, it can be done free of charge.
      • ② When issuing admission tickets under the provisions of Paragraph 1, free invitation tickets may be issued within the range of 10% of the available seats for each performance.
      • ③ When issuing tickets pursuant to the provisions of Paragraph 1, discounts may be applied within 50 percent of the ticket price for the purpose of revitalizing performances and increasing the cultural welfare of citizens. The specific targets and criteria for discounts shall be determined by separate internal guidelines.
    • Section 24 (Restrictions on Admission)
      • If any of the following items fall under 1, the director may refuse admission or order the spectator to leave.
      • 1. drunk and trespassers
      • 2. carrying items that pose a danger to others or are disruptive.
      • 3. possesses an admission ticket that has not been verified by the ledger
      • 4. any other person deemed necessary by the Leader to maintain security.
  • Chapter 4 Publicity, broadcasting, promotions, and more
    • Article 24 (Consultation on Advertising and Promotional Materials)
      • The hirer shall consult with the director in advance regarding opera house-related matters when producing various advertisements or publicity materials necessary for the performance.
    • Article 25 (Broadcasting and Promotions, etc.)
      • ① When recording or broadcasting a performance at an opera house, you must obtain the approval of the director and pay the rental fee. In this case, you must discuss the location and facilities with the director in advance.
      • ② If there are seats that interfere with the viewing due to the broadcast, the tickets for those seats must be kept by the opera house.
      • ③ When holding promotions and signing sessions during the performance, prior approval must be obtained from the director.
  • Addendum
    • Article 1 (Effective Date)
      • ① These bylaws shall take effect on the date they are approved by the President.
      • ② (Transitional Measures) Prior to the enforcement of these Bylaws, the internal policies and operation plans that are being implemented or are being used with a license, or the application for a license has been received and the license process is in progress, shall be deemed to be governed by these Bylaws.
  • Addendum (Mar. 15, 2023)
    • Article 1 (Effective Date)
      • These bylaws shall take effect on the date they are approved by the Secretary
